The pending Florida school vaccine rule adds a new requirement for medical practices that use the state immunization registry, known as Florida SHOTS, to inform parents of patients under 18 how to opt out of the record-keeping provision.

Revised provider agreement adds opt-out notice

The change appears in the updated Private Provider User Agreement, form DH8038-DCHP-08/2026, which practices must sign to access Florida SHOTS.

Under the agreement, clinics must provide the Florida SHOTS notification and opt-out form to any parent who asks, in English, Spanish or Haitian Creole, and must embed the opt-out notice in the consent-for-treatment document for patients up to age 17.

Additional obligations include compliance with Florida Cybersecurity Standards (Rules 60GG-2.001-2.006), prohibiting shared credentials, terminating user accounts within 30 days after staff separation, and participating in periodic access reviews.

The agreement lasts two years from activation; the department may suspend access for non-use, confidentiality breaches, or any violation of its terms.

Opt-out form shifts record-keeping to families

The opt-out form, DH8029-DCHP-08/2026, places the burden of maintaining immunization records on the family and front-desk staff.

Parents who choose to opt out must submit a completed form at each vaccination event and are responsible for supplying records to schools, child-care facilities and colleges.

The form also clarifies that opting out does not exempt a child from vaccinations required for school or child-care attendance.

Regulatory context and stakeholder response

The comment period closed on September 14. The Florida Chapter of the American College of Physicians, representing roughly 10,000 physicians, requested a hearing through attorney Christopher Nuland, noting that the vaccines in question have been shown safe and effective in vetted studies.

The Florida Chapter of the American Academy of Pediatrics also urged its members to comment and to seek a hearing.

As of September 22, no hearing notice, amendment filing or adoption notice had appeared in the rule’s docket. The Department of Health can adopt the rule by filing it with the Department of State, and Governor Ron DeSantis has indicated a desire to finalize the policy before leaving office.

Impact on vaccine requirements and practice operations

The proposal removes hepatitis B, varicella, Haemophilus influenzae type b and pneumococcal conjugate vaccines from school-entry requirements, but it does not alter the statutory mandate for polio, diphtheria, rubeola, rubella, pertussis, mumps and tetanus.

The revised religious exemption form, DH8033-DCHP-08/2026, now allows parents to cite sincerely held moral or ethical beliefs alongside religious tenets, consolidating those categories under a single exemption process that still runs through the county health department.

More opt-outs will likely increase the number of children without a record in Florida SHOTS, leading to additional paperwork, phone calls to previous providers and potential repeat vaccinations when records cannot be located.

Practices that stock private-label vaccine doses may face inventory challenges if demand for the removed vaccines declines, leaving doses with fixed expiration dates on shelves; checking return and credit terms with distributors is advised.

Childhood immunization combination rates feed HEDIS scores and Medicaid managed-care incentive payments. If uptake falls for reasons beyond a practice’s control, the practice will still bear responsibility for the quality metric.

The Department of Health reported 155 measles cases in 2026, a sharp rise from the seven cases recorded in 2025, showing a concerning backdrop for vaccine-preventable diseases.

Next steps for providers

Clinics should monitor the rule docket rather than relying solely on news coverage. Once the department files for adoption, the rule becomes effective 20 days later, and the revised forms will take immediate effect.
